This Privacy Policy Explained

Canisubdivide understands that your privacy is important. This Privacy Policy gives detail on how we intend to collect, store, use, disclose, protect and otherwise handle your personal information, in accordance with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act).

This Privacy Policy doesn’t constitute a contractual representation, promise, guarantee or warranty by us to you as to the manner in which we will or may collect, store, use, disclose, protect or otherwise handle your personal information.

Who this Privacy Policy applies to

This Privacy Policy applies to canisubdivide (Eight Planning Pty Ltd t/as canisubdivide) and all of its associates, wholly owned subsidiaries, partnerships, trusts, joint venture entities and brands in Australia (the Group) and their agents, employees and associates (referred to as the ‘we’, ‘us’ and ‘our’). Each of us comply with the same obligations to protect your personal information as set out here. 

This Privacy Policy does not cover the privacy practices of third parties that we do not own or control, such as our third-party advertising and commercial partners, any referral partners,their related bodies corporate and service providers (Partners),  or any other unrelated third party. 

When you sign up to our website, or use our services or products, your information will be collected by us in accordance with this Privacy Policy and may be shared with and processed by our Partners and other third parties, in accordance with their own privacy policies and terms and conditions. You should review the policies of our Partners before submitting personal information to us.

What’s personal information?

Personal information is information or an opinion about you, whether true or not and whether recorded in a material form or not, from which you can be reasonably identified.

Why do we collect personal information?

We collect personal information in connection with providing our services and products to you, administering, improving and personalising our services and products, improving the experience you have with us, notifying you about our services and products and new products or services, discounts, promotions or upcoming events and to support our business functions.

We may provide your personal information to Partners in the course of providing our services or products. If we didn’t, they might not be able to give you their related services or we might not be able to maintain our commercial relationship with that Partner, which could mean we would be unable to provide you with the services and products at all. 

What types of personal information do we collect?

The types of personal information collected by us include:

  • information about products and services you’ve purchased or obtained from us or which you have enquired about, together with any other information associated with us delivering those products and services and/or responding to your enquiries, 
  • any additional personal information that you provide to us directly through our website(s) or by any other means (including for example by phone or email),, or indirectly through the use of our website(s), our technology, representatives, or related third parties, 
  • information you provide to us through any of our customer surveys or visits to our websites or platforms, or by our representatives, 
  • other information you provide to us which is reasonably necessary for us to carry out our functions and activities.

How do we collect your personal information?

We will only ever collect personal information by lawful, fair means and not in an unreasonably intrusive manner. When you provide us with personal information you consent to the use, disclosure and handling of your personal information in accordance with this Privacy Policy and any subsequent amendments. 

Collecting information from you

If it is reasonable, practical, and not unduly burdensome to do so, we’ll collect personal information primarily from you. 

We may collect your personal information when you contact us, when you are contacted by us, or when you are contacted by any of our service providers, representatives or related third parties,through our website, by phone (including text messaging), by email, via social media, or through other means. We may also collect your information when you provide it to us by completing forms or documents and otherwise providing it to us in any way. 

Collecting information from third parties

We may also collect information about you from other people or independent sources. For example we may collect information from our Partners or other members within our Group. Where we have collected your information from a third party, such personal information will be held, used and disclosed by us in accordance with this Privacy Policy.

Collecting information about others

If you provide us with the personal information of anyone else (as their authorised representative), we rely on you to inform them that you are providing their personal information to us. You must also advise them that they can contact us for further information. You must take reasonable steps to make sure that the person(s) are aware of and consents to the various matters detailed in this Privacy Policy, including the fact that their personal information is being collected, the purposes for which that information is being collected, the intended recipients of that information, the individual's right to obtain access to that information, our identity, and how to contact us.If we request it, you are required to assist us with any requests by that person(s) to access / update the personal information you provided to us.

Collecting information from visits to our websites

We may collect information about how you visit, interact with, and use our websites and other digital services. For example, we record the date and time of your access, your IP/server address, the page(s) you accessed, anything you downloaded, the previous site you visited and the type of device, browser and operating system you use. We only use and disclose this information in aggregated, anonymous format for purposes like statistical analysis and to assist us to improve the functionality and usability of our online/digital services. This doesn’t individually identify you, but we reserve the right to use or disclose this information to try to locate somebody where we reasonably believe that they might have engaged in any unlawful or inappropriate activity in connection with our website, or where we are otherwise required or authorised by law to do so. We may also collect information based on how you use any of our websites, including through 'cookies' and other similar technologies.

We use cookies to provide you with a more consistent experience across our services. We don’t use cookies to personally identify you, but if there is information in a cookie is linked with personal information as set out above, this becomes personal information and will be treated accordingly. You can remove or reject cookies by adjusting the settings on your browser (but note that some components of our website(s) or digital services might not function properly (or at all) for users that disable them.

Google Analytics 

We use Google Analytics to better understand your behaviour and provide targeted advertising to suit your interests and preferences. This information also helps us measure the usefulness of certain parts of our website and online services. We may implement a range of Google Analytics Features on our website. You can opt out of the Google Analytics Advertising Features by downloading the Google Analytics ‘Opt-out Browser Addon’.

Unsolicited information

If we receive personal information that we have not requested and determine that the personal information received is not necessary to provide our services, we’ll take reasonable steps (if any) to de-identify or destroy that personal information.

Anonymity/pseudonymity

Generally the nature of our services and products require that you provide accurate personal information about yourself. In limited circumstances though, where it doesn’t impact the delivery of our products or services, you may, if practicable, be able to interact with us anonymously or by using a pseudonym. 

How we store your personal information

The security of your personal information is important to us, so we take reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification or disclosure.These steps include the implementation of:

  • access controls;
  • system firewalls and network security;
  • data encryption;
  • regular security audits;
  • employee training; and
  • regular software updates.

We will take reasonable steps to permanently de-identify or responsibly destroy personal information if it is no longer needed for the purpose for which the information was used or disclosed.

Security breach procedures

We have adopted data security practices with a view to protecting the data we have. Nevertheless, you should be aware that there are inherent risks associated with the transmission of data over the internet and other mediums. Accordingly, we cannot guarantee any transmission will be completely secure.

Use and disclosure of your personal information

We may hold, use or disclose your personal information for a range of purposes so that we can provide products and services that you request, give you access to our products or platforms, identify and promote products or services that may be of interest to you, respond to your enquires and to share with our Partners for marketing and analytics purposes; e.g. we may hold, use or disclose your personal information to:

  • Maintain, improve, iterate, or diagnose issues with our services, products, website, or online platform(s),

Direct Marketing

As noted earlier in this Privacy Policy, we may use your personal information to identify and promote products or services that might be of interest to you. We might also disclose your personal information to our Partners (including referral partners and third party providers associated with the provision of our products or services), for them to provide additional services or products, undertake marketing, or for analytics purposes.

At the time of signing up to any of our platforms, purchasing a product or service, or subscribing for any updates you agree to the terms of this Privacy Policy and provide your consent to us sending you commercial electronic messages containing marketing or promotional materials and other information about our products and services, and the products and services of our Partners. We may also seek your consent for us and/or our Partners to send you marketing or promotional materials and other information.

Where permitted by any applicable privacy laws, we may, from time to time:

  • use your personal information to send you information about promotions,competitions, deals, products or services we offer or the products or services of our Partners, and any other information that we consider may be relevant to you; and
  • disclose your personal information to our Partners for the purpose of that Partner contacting you for promotional or marketing purposes. For example, a specified Partner may send you information about special deals, products or services they offer and other information that may interest you.
  • At any time, you may opt out of receiving direct marketing communications from us. To do so, use the unsubscribe or opt out link that is contained within an email from us. You can also opt out of direct marking communications from our Partners by using the opt-out link in their communications or contacting them directly.

How is personal information disclosed to others?

Disclosure to service providers

In order to provide our products and services or to support our business functions, we may disclose your personal information to third parties in limited circumstances, including to external providers that perform services on behalf of our Group.

Disclosure to Partners and those within our Group

We may also disclose personal information to any of our Partners to enable them to conduct marketing and analytics, with other entities in our Group for the purpose of providing you with any agreed products or services.

Cross-border disclosure

We generally do not disclose any personal information to entities located overseas. However, we may transfer your personal information to an entity which is in a foreign country to assist us in providing our products and services. For example, your personal information may be stored on servers located overseas by our third-party cloud storage providers, or it may be provided to current or potential contracted overseas services providers or partners where the provision of our products or services requires the transfer of the information. In these circumstances, we will take reasonable steps to ensure that the information that is transferred to third parties located outside of Australia will not be held, used or disclosed by the recipient of the information in a manner that is inconsistent with the relevant Australian Privacy Laws.

Our websites and digital platforms may contain links to other websites. We do not share your personal information with those websites and we are not responsible for the privacy practices applying in respect of those websites.

Age restrictions

We do not knowingly process the personal information of children under the age of 16. If you are under the age of 16, we need the consent of your parent or guardian to process your personal information.If you are under the age of 16, please do not use any of our websites, products or services without your parent or guardian's consent. If you suspect that a child under the age of 16 has provided personal information to us, please notify us immediately via the ‘contact us’ section of our website or by emailing ‘hello@canisubdivide.com.au’ 

Change of control

If we sell, assign or otherwise transfer part or the whole of our business to a third party, your personal information, which was collected by the us through that service, may be among the items transferred or sold to the extent that it is relevant to that entity's business.

How you may access or correct your personal information

You may contact us to request access to the personal information we hold about you at any time. You may also ask us to correct information about you that you may believe is inaccurate, incomplete or out of date.

We will respond to the request within a reasonable period after the request is made. There is no charge to make a request. However, we may charge a reasonable fee to cover the administrative costs of retrieving your personal information.In certain circumstances, we may refuse, or be unable, to correct or provide you with access to your personal information. In these circumstances, we will write to you to explain the reasons why this is the case.

How you may complain if you have concerns 

If you have a complaint related to how we have managed your personal information, please contact us using the contact detailed above. We may ask you to place your concerns in writing so that our compliance staff can fully understand and investigate your complaint. We will provide you with an estimated response timeframe in relation to your complaint. In any event, we’ll aim to respond to your complaint within 30 days.If a complaint remains unresolved, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au to have the complaint heard and determined.

Changes to our privacy policy and information handling practices

This Privacy Policy is subject to change at any time, so we encourage you to review this Privacy Policy at regular intervals. If we change this Privacy Policy, an updated version will be posted on our website and we will notify you of this change. By continuing to use our services after that time, you will be deemed to have accepted any changes to our Privacy Policy.
